Any reference to “us/we” or “our” in these terms and conditions is a reference to Session Kit. Any reference to “you/your” is a reference to the user of the website. By accessing our website, browsing content, submitting information or using the online shop, you agree to and are bound by our terms and conditions, policies and notices within this page. Please keep a copy and read for future reference. We reserve the right to change any content, term and conditions, notices or policies within our website without any prior notice the user. We will attempt to make you aware of any changes regarding the shop (i.e. adding or removing products for sale or pricing changes) but it is the responsibility of the user to check for any changes. If the website www.sessionkit.com is temporarily unavailable for any reason, we are not responsible for any impact this may have on the user. We reserve the right to restrict access to the website without notice, at any given time, for any period of time.

We may use small bits of data called cookies, which are stored on users' computers to simulate a continuous connection and keep track of information about how you browse our website. Our website requires the use of some cookies to enable you to add items to your shopping bag. Without these cookies you would not be able to place your order. We also use cookies for site performance feedback. We use Google Analytics, Google Double-Click and Google Adwords to understand and monitor the effectiveness of our site. Privacy policy
At Session Kit we respect your privacy. There are certain features on our website which may require you to give us personally identifiable information about yourself. This relates to signing up to our newsletter, filling out forms and using our online shop. Personally identifiable information (PII) is any information about you as an individual, such as your name, address, telephone number, credit card number and billing information, birth date, email address and purchase history. Whether or not you provide your PII to us is completely up to you, but if you choose not to provide the information we request, you may be unable to use some of our services.

Website security
Your PII is stored on our computers in a controlled environment with reasonable protection against unauthorised access and misuse. The shop functionality on our website uses the Stripe payment platform. Stripe security has achieved the most stringent level of certificate available (PCI level1) and all transactions are protected with SSL technology.
Opting Out
If you would like to opt out of receiving promotional emails from us, please follow the unsubscribe instructions located at the bottom of each email. If you would like to opt out of receiving direct mail or telephone marketing calls from us, please send your request, including your name, email, street address, city, county, and postcode via email to info@sessionkit.com. Please note that we may still use your personal information to provide you with services, including sending you administrative and transaction-related emails relating to your online shopping and your other activity on our website.

Colour reproduction
We have made every effort to reproduce colours on the site as accurately as possible. However, different computers and mobile devices reproduce colours in slightly different ways, and so exact colour matches are not yet possible over the Internet.This means that when you order products from us, colours may differ from what you see on the screen. If you are not satisfied with the colour of the item you have ordered, we operate a returns policy (see Returns for more information).
Acceptance of Goods
Upon receiving your order, it is your responsibility to inspect the goods. You will be deemed to have accepted the goods unless you notify us that you have cancelled the order and/or you return the goods in accordance with the Returns Policy. If no such action is taken, we shall not be obliged to accept any rejection of the goods at a later date. Your statutory rights are not affected. If you have not received the entire order as detailed in the ‘Order Shipped’ email sent to you when your order is dispatched, please contact info@sessionkit.com.
Contract for purchase of physical goods
When you place an order to purchase a product from us, we will send you an e-mail confirming receipt of your order, which contains the details of your order. This is your ‘Order Confirmed’ email. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that the product(s) has been dispatched to you. This is your ‘Order Shipped’ email. Any products from the same order which we have not confirmed as dispatched do not form part of that contract.
Payment
Upon receiving your order, we will carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
Cancellations/change to order of physical goods
If you have made a mistake with an order of physical products, or would like to change your order, you may contact us on info@sessionkit.com. You should do this as soon as possible. We will always do our best to accommodate changes. However, we are not able to process changes once your order has been sent or processed. You remain responsible for (and your credit card may be charged for) the payment of all fees associated with orders processed or shipped before the request is received. We will contact you via email to confirm if we are able to accommodate your request.
Pricing, Availability, Payment
The price of a product shall be as stated on this website at the time you place your order except in the case of obvious error. We try and ensure that all prices on our website are accurate, but errors may occur. If we discover an error in the price of a product you have ordered, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item to you. In those circumstances, we will inform you of the correct price as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel, no payment will be taken from your card.
Prices do not include delivery charges or other taxes which may be applied, including but not limited to customs and import charges and overseas VAT. We accept payment by debit or credit card only. Payment will be debited from your account at the time of or shortly before your order is dispatched to you.
You confirm that the credit/debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. Fraudulent use of credit cards will be reported to the relevant authorities. If the issuer of your card refuses to authorise payment, we will not accept your order and we will not be responsible for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.
Dispatch of Your Order
Dispatch times may vary according to availability. We aim to dispatch all orders within five working days. Please note that for services with a delivery aim (such as the Royal Mail 24 or 48 hour service), this time window applies from the time of dispatch, not from the moment you place your order. We cannot be held responsible for any inconvenience incurred by delayed dispatch or Royal Mail delivery times, which are out of our control.
SAFE PLACE
Session Kit cannot be held responsible for items left in a safe place. Please choose your safe place carefully. We advise only choosing places that are completely secure and inaccessible to members of the public – for example, with a neighbour or a reception desk. Requesting delivery to a safe place is done entirely at your own risk.
From the end of September 2022, if there is no recipient available to accept your parcel(s), Royal Mail may choose to deliver them to a Safeplace location at the address, if their postal worker deems that location to be suitable. In that case, they will also leave a “Something For You” card explaining where the parcel(s) is located. If Royal Mail cannot find a suitable Safeplace and cannot deliver to a neighbour, they will return your parcel to a local Royal Mail Customer Service Point and leave a “Something For You” card at your address. Delivery Charges
We offer delivery within the UK and to many other countries around the world. If you are unable to select your country at checkout, please email us at info@sessionkit.com and we will look into your delivery options. The prices shown onto the website are subject to change and we reserve the right to delay an order dispatch until a delivery charge has been agreed by both parties. A delivery charge is not confirmed as final until we send you an ‘Order Shipped’ email and notify you that your order has been dispatched.
Liability
The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary, to the fullest extent permitted by law, Session Kit and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services arising out of or related to the use, inability to use, performance or failures of this website or the linked sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect our liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.
Indemnity
You agree to indemnify, defend and hold harmless Session Kit, www.sessionkit.com, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this website or your breach of the Terms & Conditions.
Complaints
We operate a complaint handling procedure which we will use to try to resolve disputes when they first arise. Please let us know if you have any complaints or comments by contacting us via info@sessionkit.com in the first instance.
Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Returns Policy for physical products
Please see ‘Education’ terms and conditions below for information regarding cancellation of course places.
If you are unsatisfied with any products you have ordered, please follow our returns procedure, outlined below.
If you’ve changed your mind:
We will accept unused, unsealed items in their original packaging and condition.
Items must be returned within 14 calendar days for a refund.
For hygiene reasons, items will not be accepted if they have been opened or used. All tamper-resistant seals, packaging and cellophane must remain fully intact.
If you choose to return items for any reason (other than because the items received are faulty or incorrect) delivery charges are non-refundable. You will be responsible for the cost and arrangements of returning the items to us.
Please ensure you email us at info@sessionkit.com explaining why you are returning the item before you dispatch any goods to us. Providing your return meets our returns criteria we will issue a returns approval. Any orders returned without approval may be subject to additional returns handling charges.
Please ensure you obtain a proof of postage when you return the goods to us. You should retain your proof of postage in order to provide evidence to us that you have returned the products in the unlikely event that we do not receive the returned goods. We cannot accept liability for returned goods lost in transit.
If the products are damaged, faulty or incorrect:
We accept returns in the following circumstances:
If the product/s do not correspond with the description, or if they are not the product/s detailed in your ‘Order Shipped’ email.
If the product/s are damaged in transit or faulty upon receipt.
We will either deliver you a replacement product or a full refund (inclusive of the price you paid for the original product and delivery) and your reasonable costs of returning the products.
Please note that we cannot accept returned goods that we reasonably believe have been used or do not meet our returns criteria outlined above.
Please ensure you email us at info@sessionkit.com explaining why you are returning the item before you dispatch any goods to us. Providing your return meets our returns criteria we will issue a returns approval. Any returns received without prior approval may be subject to a returns handling charge.
Please ensure you obtain a proof of postage when you return the goods to us. You should retain your proof of postage in order to provide evidence to us that you have returned the products in the unlikely event that we do not receive the returned goods. We cannot accept liability for returned goods lost in transit.
Returning the Product
Once your return has been approved, in accordance with the circumstances outlined above, please send them to:

Please ensure that the returned parcel is properly sealed, and that you obtain a Proof of Postage receipt when you return the goods to us.
Processing the Refund
We will process the exchange or refund of your online order within 14 days. Once your refund has been processed it can take your card provider 3 to 5 working days to credit your account. Refunds will be processed to the original payment card. All refunds (except in the case of damaged or faulty items, or in the case of the incorrect item being delivered from the one that was ordered) are subject to a £3.00 returns handling charge.
Refunds cannot be issued until products are received and inspected by us.
Please note: we cannot accept returned goods that we reasonably believe have been used. In such circumstances, we will notify you that no refund will be issued, and you will be responsible for arranging for such goods to be returned to you within 28 days of our notification. Your statutory rights remain unaffected.
Additional Returns Information for International Customers
Please ensure you contact us prior to returning any goods from overseas. It is important to mark all returns as RETURNED GOODS – FAILED SALE. This must be clearly marked on the customs information document on the outside of the packaging. Failure to do so may result in the goods being refused at customs in the UK and being returned to sender.
If you have paid import duty for goods received, and subsequently return the goods to us, it should be possible for you to claim a refund of duties from your local customs authority. To do this, you will need to show them proof of duty paid and proof of export (such as certificate of posting) in order to claim your refund.

By booking a place on one of our courses, you agree to be bound by our terms and conditions.
Cancellations
To cancel a course booking, you must inform us, either by emailing us at info@sessionkit.com with the subject ‘COURSE CANCELLATION’.
You must clearly state your intention to cancel the course booking and email it to us before the cancellation deadline outlined below.
Refunds
Cancellations received within one calendar month of the course start date will not be entitled to a refund.
Cancellations received more than one calendar month before the course start date will be entitled to a full refund.
If we cancel the course for any reason, you will be entitled to a full refund.
We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of this reimbursement.
Cancellation by Session Kit
Whilst every effort is made to avoid changes to our courses, Session Kit reserves the right to withdraw, cancel or amend any course. If for any reason we cancel a course, all course fees will be returned in full.
COVID-19 Cancellation Policy
Please note that we are unable to offer refunds or exchanges to any customer who is unable to attend the course due to contracting COVID-19 or any other illness. We would nevertheless ask that you continue to follow local guidance, get tested if you have COVID-19 symptoms, and stay at home if you test positive.
